USE OF ANY ACCOUNT, DIALUP NUMBER OR SERVICE PROVIDED BY PEGANET OR
PEGAWORLD ACKNOWLEDGES FULL ACCEPTANCE OF ALL POLICIES.
The provider makes no warranties, of any kind, expressed or implied, and the user agrees to hold the provider harmless of any and all damages the user may suffer. This includes, but is not limited to the loss of data resulting from delays, misdeliveries, nondeliveries or service interruptions even if caused by the negligence of the provider. The provider assumes no responsibility for anything, and the user agrees that he/she is using the service at his/her own risk. The provider specifically denies responsibility for the accuracy, quality or content of any files, messages, information or data that pass through it's system.
The user understands and agrees that he/she is purchasing a service and the user agrees to use only the access information as provided to them by the provider.
The user agrees that all payments for services are made in advance, and accounts paid monthly are due and payable on the first of the month. If the user's account is opened on a day other than the first, he/she will pay the remaining amount for that month, then commence full monthly payments on the first of the following month. The user hereby authorizes the provided to bill his/her credit card each month for the service. The user requires that the account is to remain active, unless the provider is notified in writing (by US Postal Mail - E-Mail not acceptable) by the user to cancel the account. Cancelation will become effective 10 days after the receipt of written notification by the provider. The provider agrees that he will NOT close the account without such written notification, unless a violation of any provision of this agreement occurs. If an account is canceled, there is no refund for the current month or any monies previously paid. If the user is to be invoiced monthly, the payment MUST be received prior to the expiration of the account . Any account not paid by the first of the month will be subject to a late charge of not less than five dollars per month. The user understands that if an account is closed for non- payment, canceled, or terminated for any reason, any payments due, including the current month, past due amounts and late charges, if unpaid, must be paid. If the provider deems it necessary to obtain legal services to collect unpaid monies, the provider shall have the right to recover, in addition to amounts owed, any and all attorney and/or collection fees. Collection fees may be up to 50% of the total balance due from the user, and returned checks or chargebacks will incur a minimum fee of $25.00.
PegaNet makes every effort to protect the privacy for our users and we do not sell or provide email addresses of our users nor do we give out account information to anyone other than the user with written permission. However, we reserve the right to provide any information necessary to cooperate with all agencies, legal or otherwise, should a user violate the law or any standard contained herein.
